Malta to Australia RHCA: six months and the student-visa exclusion

Explains who qualifies for Malta’s reciprocal Medicare cover in Australia, why student-visa visitors are excluded, and how enrolment and the six-month limit work.

Under Australia’s reciprocal health care agreement (RHCA) with Malta, a visitor must both be a citizen of Malta and have been living in Malta or on the Maltese Islands before arriving in Australia; a person visiting on a student visa is not eligible, according to Services Australia. Cover starts on the day of arrival and ends after 6 months unless the visa expires earlier, and the visitor must enrol in Medicare to receive services and payments. Who qualifies under the Malta RHCA?

A visitor must meet both core eligibility conditions:

Does a student visa exclude a Maltese visitor?

Yes. Even if the visitor is a Maltese citizen and has lived in Malta, Services Australia states that a person visiting Australia on a student visa is not eligible under this agreement.

A person who is not eligible for Medicare cannot claim a Medicare benefit for treatment received in Australia. This eligibility conclusion is specifically about Medicare under the Malta RHCA.

Could a student-visa visitor still qualify for a Medicare levy exemption?

Possibly. If the person must lodge an Australian income tax return and was not eligible for Medicare for all or part of the financial year, they may qualify for a Medicare levy exemption.

They must obtain a Medicare Entitlement Statement from Services Australia. A levy exemption is separate from eligibility for reciprocal Medicare benefits and does not make the visitor eligible to claim treatment costs.

The visitor therefore needs to check both the length of their stay and the expiry date shown on their current visa.

Are posted diplomats treated differently?

Yes. A posted diplomat and their family can enrol in Medicare while they are posted in Australia. Their agreement cover applies for as long as they remain in Australia, rather than following the ordinary 6-month visitor endpoint.

If their Medicare eligibility is about to expire, Services Australia says they can extend it for themselves and their family online.

Do I need to enrol before using Medicare?

Yes. The visitor must enrol in Medicare to receive services and payments. The enrolment process is:

  1. Complete a Medicare enrolment form.
  2. Mail or email the form and supporting documents to Medicare Enrolment Services.

There is an important timing distinction: if the visitor received medical treatment in Australia before enrolling, they may still be able to obtain a Medicare benefit for that treatment. After enrolling, they must submit the claim; Services Australia will then determine whether a benefit is available under the agreement. This possibility is not automatic.

What services and medicines does the agreement cover?

Services Australia lists the following coverage:

  • medically necessary care out of hospital;
  • medically necessary inpatient and outpatient services when the visitor is treated as a public patient in a public hospital; and
  • some PBS prescription medicines at the general rate.

These are the categories identified by Services Australia; a visitor should not assume that every medical service, medicine or cost falls within them.
